Shaping the Landscape: Unveiling the New Rule for Federal Construction Contracts Under Davis-Bacon Act and Related Acts

The Department of Labor has issued a final rule implementing its comprehensive review of regulations applying the Davis-Bacon Act and over 70 related federal Acts. Collectively, these Acts apply to an estimated $217 billion in Federal construction contracts annually. The rule is presently set for publication in the Federal Register on August 23, 2023 and will become effective 60 days from the date of publication. The document addresses Parts 1, 3, and 5 of Title 29 of the Code of Federal Regulations. Part 1 regulations address the methodology for determining the prevailing wage. Part 3 regards anti-kickback and payroll submission rules, and part 5 codifies current practices and interpretations of existing regulations. The unpublished, 716-page document can be found here.
