NC Bill Revising Chapter 47C Becomes Law

On June 30, 2020, NC Session Law 2020-52 titled “An Act to Make Various Changes to the Statutes Governing Condominiums and Condominium Associations” was signed into law enacting numerous revisions to Chapter 47C of the North Carolina General Statutes.  The enacted revisions affect the requirements for condominium instruments such as plats and plans recorded with the NC Register of Deeds, as well as condominium declarations.  Other areas of Chapter 47C affected by the bill’s revisions include marketable title of condominiums with defective drafting, execution, or recording of condominium instruments, provisions pertaining to unit owner associations, and sections addressing declarant rights.

Most of the revisions went into immediate effect on June 30, 2020, thus requiring instruments such as new plats and plans recorded with the Register of Deeds on or after June 30, 2020 to comply with the newly enacted law.  However, the bill added a new process for judicial reformation of condominium instruments, which took effect on October 1, 2020.
